Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Zion Church Management System ("Zion CHMS", "Service") operated by Zion Church Management System. By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 18 years old, have the authority to bind your organization to these Terms, and agree to comply with all applicable laws and regulations.

2. Description of Service

Zion CHMS is a cloud-based church management platform that provides tools for managing membership records, attendance tracking, giving management, event scheduling, and communication with church members. The Service is provided on a subscription basis.

3. Account Registration

You must provide accurate, current, and complete information when registering.
You are responsible for maintaining the confidentiality of your account credentials.
You must notify us immediately of any unauthorized use of your account.
Each subscription is for a single organization. Sharing accounts across multiple organizations is not permitted.

4. Subscription and Payment

Access to the Service requires a paid subscription after any applicable trial period.
Subscription fees are billed in advance on a monthly or annual basis as selected.
All fees are non-refundable except where required by applicable law.
We reserve the right to change pricing with 30 days' notice to account holders.
Failure to pay may result in suspension or termination of your account.

5. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws, regulations, or third-party rights.
Upload or transmit malicious code, viruses, or harmful content.
Attempt to gain unauthorized access to any part of the Service or its infrastructure.
Use the Service for commercial purposes outside of your registered organization.
Harvest or collect data about other users without their consent.
Send unsolicited bulk messages or spam to members.

6. Data Ownership and Responsibility

Your church retains full ownership of all member data you enter into Zion CHMS. You are responsible for:

Ensuring you have the legal right and consent to store personal information about your members.
Complying with applicable data protection laws (e.g., GDPR, local privacy regulations).
Notifying your members about how their data is used within the platform.
Maintaining the accuracy of data entered into the system.

7. Intellectual Property

The Service, including its software, design, features, and content created by Zion CHMS, is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your organization's internal purposes. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

8. Availability and Support

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance, unexpected outages, or factors beyond our control may cause temporary unavailability. We provide support through our help desk during normal business hours.

9. Termination

Either party may terminate the subscription at any time. Upon termination:

Your access to the Service will end at the close of the current billing period.
You may export your data before termination using the export tools in Settings.
Your data will be permanently deleted within 90 days of account closure.
We may terminate or suspend accounts that violate these Terms without prior notice.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Zion CHMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising from your use of the Service. Our total liability for any claim shall not exceed the amount paid by you in the three months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or the courts of competent jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. We will notify account holders of material changes by email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
